Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of OwlAgent, the AI personal assistant on WhatsApp, and the website www.owlagent.me (together, the "Service"), operated by OwlAgent ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

2. The Service

OwlAgent is an AI assistant you interact with on WhatsApp. It can read from and act on third-party accounts you explicitly connect (such as email, calendar, files, and CRM) in order to carry out your requests. Using the Service requires a WhatsApp account, and connecting third-party services requires you to authorize each one via OAuth.

3. Accounts and eligibility

• You must be at least 16 years old.
• You must provide accurate account information and keep it up to date.
• You are responsible for activity on your WhatsApp number and connected accounts; tell us promptly if you suspect unauthorized use.

4. Plans, billing, and trials

• Paid subscriptions are billed through Stripe and renew automatically each billing period until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
• Free trials convert to a paid subscription at the end of the trial unless you cancel first.
• Lifetime licenses purchased through AppSumo are governed by AppSumo's purchase and refund terms, plus these Terms for the use of the Service.
• Except where required by law or stated otherwise, fees already paid are non-refundable.

5. Acceptable use

You agree not to:

• use the Service for anything illegal, or to infringe others' rights;
• use the assistant to send spam or unsolicited bulk messages through your connected accounts;
• attempt to breach, probe, or overload our systems, or to access other users' data;
• resell the Service or misrepresent AI-generated output in ways designed to deceive.

We may suspend or terminate accounts that violate these rules.

6. Your content and data

You own your content — your messages and the data in your connected accounts. You grant us the limited license needed to process that content solely to provide the Service. How we handle personal data is described in the Privacy Policy; we do not use your content to train AI models.

7. AI output and actions

The assistant is powered by large language models. AI output can be inaccurate or incomplete — review important results before relying on them. The assistant acts on your instructions: emails it sends, events it books, and records it updates on your behalf are your responsibility, and we recommend reviewing sensitive actions before confirming them.

8. Third-party services

WhatsApp, Google, and other services you connect are provided by third parties under their own terms. We are not responsible for their availability or for changes they make. If a provider revokes or limits API access, some features may stop working.

9. Availability and changes

We work hard to keep OwlAgent available but do not guarantee uninterrupted service. We may improve, modify, or discontinue features; if we discontinue the Service entirely, we will give paying customers reasonable notice.

10. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the same extent, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory rights you hold as a consumer.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access for material breach of these Terms, with notice where practicable. Upon closure, your data is deleted as described in the Privacy Policy.

12. Governing law

These Terms are governed by French law. Consumers retain any mandatory protections of the law of their country of residence. Disputes that cannot be resolved amicably will be brought before the competent courts.

13. Changes to these Terms

We may update these Terms. For material changes, we will update the effective date above and notify active users before the changes take effect; continued use after that constitutes acceptance.
